BIRMINGHAM, Ala.—-Scrushy lawyers continued their defense in his civil trial Tuesday with testimony about an ex-CFO punching an outgoing employee.

Leif Murphy said that at his going away party, former HealthSouth CFO Mike Martin was drunk and placed him in a headlock.

Moments after Murphy escaped the maneuver, Murphy said, “He reached over and threw a sucker punch.“

Scrushy’s lawyers are trying discredit Martin, who has testified he talked to Richard Scrushy at the fraud at HealthSouth.

Shareholders are suing Scrushy, claiming he directed the $2.7 billion scandal.

A criminal jury cleared Scrushy of similar claims in 2005.

Murphy also testified that after he had asked questions about inaccurate expenditures, Martin told him, “There are a lot of grey areas in accounting.“

Scrushy will take the stand Wednesday morning in federal court.
