Judge asks for briefs in Jeffco sewer bond case
Published: April 8, 2009
BIRMINGHAM, Ala. (AP) - A federal judge has called for both sides to submit briefs in Jefferson County’s bid to block insurers from having a receiver appointed over the county’s sewer operations.
The county had asked U.S. District Judge David Proctor to dismiss the request or temporarily halt the proceedings.
Proctor has given both sides until Wednesday to submit briefs on whether a receiver should be appointed. The deadline for reply briefs is April 15, after which he will issue a ruling.
Repayments of principal and interest on the county’s sewer debt were triggered by downgrades last year in the county’s bond ratings.
The bond insurers and the trustee for the county’s bondholder sued the county. They say it has not lived up to its financial obligations.
