Capital murder conviction reversed

A state appeals court has reversed the
capital murder conviction and death sentence of Mark Brown in the
2005 killing of four people at a Cleburne County residence.
The Alabama Court of Criminal Appeals ruled Friday that the
trial judge wrongly told the jury it could convict Brown of capital
murder even if he didn't possess the specific intent to kill, so
long as one of his two co-horts did possess such intent.
In a separate ruling, the court upheld the death sentence of
Oscar Ray Doster in the 2002 killing of Paul LeMaster of Gantt
after Doster and a second man broke out of the jail at Andalusia.
